1. Agreement to Terms

Obsidian Bloom provides the following design and management services:

  • Web Page Designing
  • Graphic Designing
  • Post Designing
  • Minecraft Event Managing
  • Discord Server Setup

All services are subject to availability and may be modified, suspended, or discontinued at any time without prior notice.

3. Project Quotations and Pricing

All prices are quoted on a per-project basis. Quotations are valid for 30 days from the date provided unless otherwise specified. Final pricing may vary based on project scope and requirements.

Payment terms will be agreed upon before project commencement. We reserve the right to require partial or full payment upfront for certain projects.

4. Project Timeline and Delivery

Project timelines are estimates and may vary based on complexity, client feedback, and revisions. We strive to meet all agreed-upon deadlines but cannot guarantee delivery by a specific date unless explicitly stated in a written agreement.

Delays caused by the client (such as late feedback or material provision) may result in extended delivery times.

5. Revisions and Changes

The number of revisions included in each project will be specified in the project agreement. Additional revisions beyond the agreed-upon number may incur additional charges.

Major changes to project scope after commencement may require additional fees and timeline adjustments.

6. Intellectual Property Rights

Client Ownership:

  • Upon full payment, clients receive ownership of the final deliverables
  • Clients may use the deliverables for their intended purpose without restriction

Obsidian Bloom Rights:

  • We retain the right to display completed work in our portfolio
  • We may use project work as case studies or promotional materials
  • Any code, templates, or resources we create may be reused in future projects

Third-Party Assets:

  • If third-party assets (fonts, stock images, plugins) are used, clients are responsible for obtaining necessary licenses
  • We will inform clients of any third-party assets that require licensing

7. Client Responsibilities

Clients agree to:

  • Provide accurate and complete information for their project
  • Respond to communications and requests in a timely manner
  • Provide feedback and approvals within agreed-upon timeframes
  • Ensure they have rights to any materials they provide for use in the project
  • Make payment according to agreed-upon terms

8. Refund and Cancellation Policy

Cancellations:

  • Clients may cancel a project at any time before work begins for a full refund
  • Once work has begun, clients will be charged for work completed up to the cancellation point
  • We reserve the right to cancel a project if the client breaches these terms

Refunds:

  • Refunds are considered on a case-by-case basis
  • Completed and delivered work is non-refundable
  • Partial refunds may be issued if we fail to deliver services as agreed

9. Confidentiality

We respect the confidentiality of your project information. We will not disclose confidential client information to third parties without consent, except as required by law or as necessary to complete the project (e.g., working with subcontractors).

If a Non-Disclosure Agreement (NDA) is required, it must be signed before project commencement.

10. Warranties and Disclaimers

We warrant that services will be performed with reasonable skill and care. However, we make no guarantees regarding specific results, rankings, traffic, or sales.

All work is provided "as is" without warranty of any kind, whether express or implied. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Obsidian Bloom shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our services.

Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.

12. Website Use and Conduct

When using our website, you agree not to:

  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights
  • Transmit harmful code or malware
  • Attempt to gain unauthorized access to our systems
  • Use our contact forms for spam or unsolicited communications
